Visiting this online shop and placing orders through you are considered having read, understood and agreed to the following terms and conditions :

1/ “Bird of a feather”, as well refered to “we” and “us” in these conditions, is a sole trade enterprise owned, as well as any logo, picture, item on this shop, by Emilie Simoës.

The principal place of Business adress is : appartment 24 – 5 temple street / 3 temple Square L2 5 BA – Liverpool, Merseyside, UK.

We consider as “customer” any person, natural or legal willing to place an order with this online shop.

2/ Each piece of jewellery made buy Bird of a feather is handmade or hand-assembled, according to the raw materials found and to their quantity.

Each piece is usually unique but we might as well produce a few pieces out of a same model. In this case, not all the pieces can be exactly similar. Slight differences might be percieved. Moreover, although we tried to give a very close sight of the real jewellery through the pictures of this online shop, the ressemblance may not be absolutly perfect.

3/ Although we choose our raw material paying attention to solidity and confort, we kindly advice you to avoid wearing the jewelleries on a daily basis and recommend to handle them carefully, some of them being possibly fragile.

We remind you that these jewelleries are not at all jeweller’s craft but handmade by their creator.

4/ Bird of a feather commits itself to sending orders of available jewelleries within 24 hours, from the date of order’s validation.

If a piece of jewellery is not available anymore, the customer can contact the company which will try as far as possible to comply with the request. Jewelleries in “pre-order” are shipped within 8 days maximum from the date of the order’s validation. The customer is informed of any product out of stock through the pages of jewelleries’ presentation. Any information regarding temporary delays will appear on the online shop. Any other information will be provided by email.

5/ Bird of a feather intend to make each customer fully happy with her / his purchase. However, we maintain a 20 days return policy, starting from the day of the order’s confirmation. The order can be fully or partially returned.

The customer will then receive a refund, including the return shipping costs (but not the order shipping cost).

If any jewellery is faulty or arrives damaged, the customer can return it and choose between a full refund, including all the shipping taxes, or an exchange. In this last case, only the return shipping costs and the new order shipping costs will be refunded.

6/ We offer to the customer a free fixing service up to three months from the day of the order’s confirmation. Any damaged jewellery can be returned and fixed for free. The shipping costs of this return will be refunded and the new shipping will be free of charge.

7/ The customer is being offered two ways to pay for the order : credit card or paypal account, via the online shop Bird of a feather hosted by Big Cartel.

8/ The prices published on the online shop Bird of a feather are all taxes included, except for the shipping costs which are displayed after the shipping adress is inserted, and before the purchase completion.

All prices are in British Pounds (GBP).

Bird of a feather is allowed to change the prices, although the cost of an order cannot be changed from the day of the order confirmation.

9/ Orders will be delivered by Royal Mail.

Within the UK, the shipping cost is 4,30 pounds – delivery within 3 or 4 working days (signed for 1^st class).

For any other country, the shipping cost is 6,50 pounds – delivery between 5 and 10 working days (Royal Mail International Tracked and Signed). For any shorter delivery period, the customer can contact us so that we offer alternative solutions. Any cost supplement will be at the customer’s charge. 

Jewelleries are posted in lovely cases (boxes or bags) and are packed, according to their volume and fragility in envelopes and postal boxes.

10/ Bird of a feather is willing to provide the customer with any useful information regarding the status of her / his order. An email will be send to confirm the order and another one to give the tracking number that will allow the customer to follow the delivery’s steps. In general, for any matter regarding her / his order, the customer will be reached by email.

11/ Intellectual property : the logo and the creations Bird of a feather are protected by both the UK and France legislations.

– UK : UK Copyright Law : 2 Rights covered : The law gives the creators of literary, dramatic, musical, artistic works, sound recordings, broadcasts, films and typographical arrangement of published editions, rights to control the ways in which their material may be used.

4 When rights occur : Copyright is an automatic right and arises whenever an individual or company creates a work.

– FRANCE : Code de la propriété intellectuelle Article 111-1 : L’auteur d’une oeuvre de l’esprit jouit sur cette oeuvre, du seul fait de sa création, d’un droit de propriété incorporelle exclusif et opposable à tous.

Propriété industrielle Article L-511-1 : Peut être protégée à titre de dessin ou modèle l’apparence d’un produit, ou d’une partie de produit, caractérisée en particulier par ses lignes, ses contours, ses couleurs, sa forme, sa texture ou ses matériaux. Ces caractéristiques peuvent être celles du produit lui-même ou de son ornementation.

Est regardé comme un produit tout objet industriel ou artisanal, notamment les pièces conçues pour être assemblées en un produit complexe, les emballages, les présentations, les symboles graphiques et les caractères typographiques, à l’exclusion toutefois des programmes d’ordinateur.

Article L-511-3 : Un dessin ou modèle est regardé comme nouveau si, à la date de dépôt de la demande d’enregistrement ou à la date de la priorité revendiquée, aucun dessin ou modèle identique n’a été divulgué. Des dessins ou modèles sont considérés comme identiques lorsque leurs caractéristiques ne diffèrent que par des détails insignifiants.

12/ confidentiality : The information provided by the customer or the potential customer through the online shop “Bird of a feather” are strictly confidential and only used by the designer to ship the orders and receive the money. They are not shared with anyone nor used for any other purpose.
